1. Scope and Application

These Terms and Conditions ("Terms") govern the acquisition and use of the WPtoCloud plugin ("the Plugin"), developed and marketed by RR Computing ("we", "the Provider"), a company incorporated in the Principality of Andorra. WPtoCloud is the commercial product name. By installing, activating, or using the Plugin, you ("the User") agree to be bound by these Terms. If you do not accept these Terms in their entirety, do not install or use the Plugin.

2. Software License

Upon acquiring a valid subscription, you are granted a personal, non-exclusive, non-transferable, revocable license to install and use the Plugin on the number of WordPress sites specified in your plan. The PHP code of the Plugin is distributed under the GNU General Public License v2 or later (GPL v2+), in accordance with the WordPress ecosystem requirements. The license validation service, visual assets, and proprietary documentation are governed by these Terms.

3. Requirements and Third-Party Dependencies

The Plugin requires: (a) a functional WordPress installation (version 5.6 or higher recommended); (b) PHP 7.4 or higher on the hosting server; (c) an active Amazon Web Services (AWS) account with access to Amazon S3. WPtoCloud is not affiliated with Amazon Web Services, Inc. AWS and Amazon S3 are trademarks of Amazon.com, Inc. You are responsible for complying with AWS terms of service and any costs arising from your use of AWS.

4. License Key and Activation

Each subscription includes a unique license key that must be entered in the Plugin settings. The key authenticates the installation against our servers and verifies the domain, status, and plan limits. The key may only be used on the number of sites authorized by your plan. Sharing, reselling, redistributing, or sublicensing the key is strictly prohibited. WPtoCloud reserves the right to deactivate keys used fraudulently or abusively without notice.

5. Subscriptions and Renewals

Monthly and annual plans renew automatically at the end of each billing cycle unless cancelled in advance. The charge will be made to the registered payment method. WPtoCloud will provide reasonable advance notice of any price changes. You may cancel your subscription at any time from the customer portal; cancellation takes effect at the end of the current period.

6. Refund Policy

Annual plans include a 14-day satisfaction guarantee from the date of purchase. To request a refund, contact support at /contact with your order number before the deadline expires. Monthly plans are non-refundable unless applicable consumer protection laws in your jurisdiction provide otherwise. Downloaded or activated digital products may be excluded from the right of withdrawal under Directive 2011/83/EU if the user has expressly consented to the start of performance.

7. Intellectual Property

WPtoCloud and its licensors own all intellectual property rights in the Plugin, its documentation, logos, and interfaces to the extent not covered by the GPL. Decompiling, reverse-engineering, or extracting the license validation service code is prohibited. Use of the "WPtoCloud" name or trademarks without prior written authorization is expressly prohibited.

8. Personal Data Processing

For service management, RR Computing collects and processes: email address, name or company name, VAT/NRT number for invoicing, WordPress site domain, and payment data (handled by the payment processor, not stored on our servers). Processing is carried out in accordance with Andorra's Llei 29/2021 qualificada de protecció de dades personals i de garantia dels drets digitals (LQPD). Andorra holds a European Commission Adequacy Decision, meaning data transfers from the EU/EEA to Andorra are permitted without additional safeguards. 9. AWS Liability and Third-Party Costs

You are solely responsible for the configuration, security, and costs of your AWS account and Amazon S3 bucket, including IAM policies, access control, encryption, and storage and data transfer costs. WPtoCloud does not store or have access to your AWS credentials. The Provider will not be liable for data loss, unauthorized access, unexpected charges, or service interruptions originating in AWS infrastructure.

10. Disclaimer of Warranties

The Plugin is provided "as is" and "as available". WPtoCloud makes no warranties, express or implied, including those of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Plugin will operate uninterrupted, be error-free, or be compatible with all environments, themes, or third-party plugins.

11. Limitation of Liability

To the fullest extent permitted by applicable law, WPtoCloud's total liability to you shall not exceed the amount paid for the subscription in the twelve (12) months preceding the event giving rise to the claim. In no event will we be liable for indirect, incidental, special, or consequential damages, loss of profits, data loss, or business interruption, even if advised of their possibility. Certain jurisdictions do not allow these exclusions, so they may not apply in full.

12. Modifications to the Terms

WPtoCloud reserves the right to modify these Terms at any time. Material changes will be communicated by email or via a notice in the Plugin administration panel at least 15 days in advance. Continued use of the Plugin after the new Terms take effect constitutes acceptance. If you do not accept the new Terms, you must stop using the Plugin and cancel your subscription.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Principality of Andorra. However, consumers residing in the European Union shall benefit from the mandatory consumer protection rules of their country of residence, in accordance with Regulation (EC) 593/2008 (Rome I). The parties will attempt to resolve any dispute amicably. If no agreement is reached, disputes shall be submitted to the exclusive jurisdiction of the courts of the Principality of Andorra, without prejudice to mandatory consumer venue rights.
